The lawsuit was filed in October 2024 by sci-fi author Matthew Kelsey Martineau, who claims Bungie copied elements from his story, published under the pseudonym Caspar Cole. Both works feature similar elements, including the "Red Legion," flamethrowers, and war hounds.

The challenge for Bungie's defense is exacerbated by the fact that the relevant campaign was removed from the game and placed into the Destiny Content Vault, making it unplayable.
